Also check out Terry Gross’s interview of Duhigg on this topic for Fresh Air, “In Digital War, Patents Are The Weapon Of Choice” (” New York Times business reporter Charles Duhigg says that consumers and innovation are the big losers in the patent wars. “Patents have become a toll gate on the road of innovation,” he says.”).
Duhigg is obviously not a patent lawyer, since he misstates a few nuances of patent law, but his overall critique of the patent system is good, even if he shies away from pure abolitionism and principle in favor of a more incrementalist and utilitarian approach.
