“If we had a free society with a decentralized, non-legislated legal order, it is impossible to imagine there being patent or copyright law or claims, any more than someone could make a minimum wage or Americans with Disabilities Act claim absent those federal statutory schemes.”

Minimum wage and disability claims could happen via a guilt campaign in which employers could be persuaded not to view these laws as extortion.

We already see this happening with copyright and patent laws. While the public isn’t buying that downloading = shoplifting, they are already convinced that downloading is a form of theft.
