Trademark Law is (Johnny) Bananas

As I’ve noted many times, patent and copyright are the worst, most virulent forms of IP, but trademark and trade secret law have also become distorted and are used to hamper competition and expression (see e.g. illustration in  in my post The Patent, Copyright, Trademark, and Trade Secret Horror Files. The latest example of a ridiculous use of trademark law (and related doctrines such as publicity rights) is described in the post MTV Star Sues Entourage, HBO Over ‘Johnny Bananas’.
